George R. Laufenberg (an ex-administrative manager for the union's pension funds) was indicted on charges relating to embezzling of union funds. Laufenberg is charged with illegally diverting money from the union into his personal paycheck without the approval and face five years in jail and a $250,000 restitution.


Laufenberg, a former Commissioner of New York's Port Authority of New York and New Jersey, was charged with embezzling $1.5 Million in pension funds, deferred payments, and excess annuity contribution. He also allegedly used the authority he held to grant his friend full salary and deferred pay he received from his union. Laufenberg was fired from the union in late 2016. He resigned in the early 2017 from his post on the Port Authority Board. The charges were brought against Laufenberg because he abused his union power to take from the benefits plans of his employees. Laufenberg said that he had been compliant with union rules, and that he placed his friend on union payroll, despite the fact he knew that it was a temporary position.

Chris Christie, former governor of NJ, appointed Laufenberg as the Port Authority of NY & NJ. He allegedly stole benefits plans money and diverted funds into his own personal accounts. He also allegedly falsely filed federal tax returns and diverted annuity funds to his own pay. Laufenberg allegedly stole $120,000 in pension benefits and deferred payments, and gave his friend and associate full salaries, bonuses, and without approval.

Laufenberg was on a $300,000.- salary when he began to get his benefits. He also received an $180,000 annual deferred payment. His actions allegedly involved allowing a friend to draw a full salary with pension and annuity contributions and benefiting from the union's health care plan. Laufenberg is facing a maximum penalty up to five years in prison as well as a $250,000.00 fine. Laufenberg's attorney did not immediately respond to a phone call seeking comment on the charges against him.

Laufenberg admitted to falsifying statements in a form required by ERISA

Laufenberg was the administrator of the Northeast Carpenters Pension Fund. It was administered by the Employee Retirement Income Safety Act. He admitted to embezzling $140,000 of the pension fund. Moreover, Laufenberg admitted to making false statements in ERISA forms. Violations of ERISA may result in fines or imprisonment.

If a person knowingly makes a materially false statement on a plan document, or fails to produce the required documentation, then the ERISA Act can lead to criminal charges. A Section 1027 Code conviction can lead to a penalty of up to five or 10 years in prison. Even though ERISA convictions are harsh, it's possible to avoid long-term prison by arguing that the statements made weren't fraudulent or misleading. Human errors are not uncommon. The law recognizes this and allows for a defendant to argue that the statements made were verifiable.
